Allahabad HC: Criminal Contempt Notice issued to a lawyer who misbehaved with a Civil Judge

Based on a complaint dated 06-11-2020 made by Varnika Shukla, Civil Judge (Junior Division), the Allahabad High Court has issued a notice of Criminal Contempt to a lawyer on 11th November.

The matter came up after the allegations made that the Advocate Vijay Kumar Pandey has misbehaved with the presiding officer using abusive language, created obstruction in the proceedings of the court, manhandled the court, tore, snatched & threw the order, terrorized and pressurized the court.

The Two Judge Bench of Justice Ritu Raj Awasthi & Justice Saroj Yadav has observed that “Prim facie, the conduct of Vijay Kumar Pandey, Advocate amounts to committing Criminal Contempt.”

In its order, the High Court has noted that the allegations made in the complaint dated 6.11.2020 are very serious in nature. And the notice of criminal contempt to Advocate Vijay Kumar Pandey was issued through Chief Judicial Magistrate, Pratapgarh.

The Court, therefore, has listed the matter for further hearing on 07.12.2020.

The Court also directed that Vijay Kumar Pandey, Advocate has to personally present before this Court on the said date of hearing.
