A petition was filed under Public Interest Litigation by Advocate Bhanya Kumar Jain in the Jabalpur Bench of the Madhya Pradesh High Court seeking regular hearing in all subordinate courts of the state, including the main bench of Jabalpur, Indore and Gwalior bench of the High Court.
According to the PIL, since the National Lockdown was pronounced from March 2020 the High Court and the subordinate courts have remained locked. And has resulted in heavy financial losses for lawyers and clients, along with ‘mental pain’. Further, the petitioner argued that “when the unlocking has started in one state after another, why have hearing in regular courts not started?”
In his plea, he has highlighted that many of the state’s lawyers are in financially weak condition and has suffering from mental stress & depression. He also claimed that the basic area of livelihood seems to have slipped from their hands due to the constant closure of the courts.
Further, Advocate Jain also considered that only matters of significant nature were heard through Video conference which has heavily increased the burden of pending cases in large number for longer time. Therefore, it leads to a tense situation between the parties and the lawyers.
