Calcutta High Court put a stay on the investigations carried out by the police against Bhartiya Janta Party leaders Kailash Vijayvargiya and Mukul Roy for participation in a demonstration and the FIR in relation to it. As per the State Government, the demonstration was unlawful.
The matter: A case was filed at the Hastings Police Station in Kolkata, against the BJP leaders. They then moved to the High Court for quashing the proceedings carried out. The petitioners submitted that false charges are being put on them.
Hon’ble Justice Rajasekhar Mantha was hearing the court proceedings. The Counsel for the petitioners was Senior Advocate Sekhar Basu and he submitted that:
“FIR has been registered in violation of and completely ignoring the law laid down by the Hon’ble Supreme Court of India in the case of Ramlila Maidan Incident reported in (2012) 5 SCC 1, particularly paragraph 245 thereof”.
On the other hand, the Additional Public Prosecutor submitted that a Special Bench has already been formed for investigation and proceedings against the Member of Parliament and Member of Legislative Assembly and therefore, there is no need to entertain the instant revisional application by the Court.
The Single bench stayed the investigations and the proceedings taking place against the BJP leaders.
