On Wednesday the Karnataka HC granted 4 weeks of time to the state government to comply with the order as the last chance. Earlier HC was directed to consider providing 1 % reservation for the transgender in all state-owned corporations.
The bench comprising of Chief Justice Satish Chandra Sharma and Justice Sachin Shankar Magadum held that “State government to act the previous order of the court within four weeks of time”.
On August 18, the court stated that “the state government to take steps and provide 1% of reservation to the trans genders in employment in Karnataka Civil Service rule 2021. Also, considering the policies of the state of the amended rules the state may consider the advisory to all the authorities established by the state for similar reservation.
The government had issued notifications earlier whereby it decided to provide 1% of reservations to Transgender candidates in government jobs through direct recruitment. The reservation would be applicable to the transgender in each category of SC, ST, and OBC category along with the general merit.
Through amendment Rule 9 (1) (d) of Karnataka Civil Services Rule, 2021 the reservation for the transgender community was incorporated. Later following this amendment senior advocate Jayna Kothari interveners submitted to consider the reservation in corporation. The court heard a petition by Sangram, working for the upliftment of sexual minorities, sex workers, and people infected with HIV. The petitioner contended the case of NALSA v Union of India.
Petitioner had given directions to the state government to include a separate reservation for the transgender for the post of special reserve constable force as well and consider all the applications by the transgender at par with two gender categories.
The matter would be next heard on November 17.
