SC dismissed a petition alleging unfair & unprofessional conduct by Apex court Registry

The Supreme Court observed that a contract is void if prohibited by a statute under a penalty, even without express declaration that the contract is void

A petition was dismissed which is filed by a Maharashtra Judge; seeking action against registry officials of the apex court for their allegedly unprofessional & biased conduct with regard to listing of cases.

A Maharashtra’s Washim, Civil Judge (Senior Division) Justice Syedullah Khaleelullah Khan in his plea has alleged that the Supreme Court registry was not treating all petitioners alike when it came to listing cases.

While rejecting the petition, a bench of Chief Justice of India SA Bobde comprising with Justices AS Bopanna & V Ramasubramanian has stated that listing cannot be contrary to the Supreme Court Rules. In its court order, the bench stated “Dismissed”.

The plea was made specifically with reference to a curative petition filed by him in a case seeking reconsideration of the top court’s 2002 judgment in “All India Judge Association v. Union of India.”

Subsequently in this petition, he submitted that unfair treatment was being meted out to him and other ordinary litigants by delaying the listing and highlighting unnecessary defects.
