Delhi Court Convict Ariz Khan, Indian Mujahideen Operative in 2008 Batla House Encounter Case

The Hon’ble Sessions Court in Delhi on 08th March 2021 sentenced accused Ariz Khan alias Junaid in the matter linking to the Batla House encounter of 2008 wherein a police inspector and two alleged terrorists were killed during the showdown between the two parties.

The Hon’ble Court convicted Ariz Khan under section. 186, 333, 353, 302, 307, 174A , 34 of Indian Penal Code, 1860 (hereinafter referred to as “IPC, 1860”) and under section 27 of The Arms (Amendment) Act, 2019 (hereinafter referred to as “Arms Act”)

The Hon’ble Additional Sessions Judge pronounced the judgment in the matter. Entire National Capital of India was shaken on 13.09.2008 when five bombs in a chain blasted at different places in its hurt i.e. Connaught Place, Karol Bagh, Greater Kailash and India Gate.

“The evidence presented on record by the prosecution leaves no matter of doubt that the prosecution has proved the case beyond all reasonable doubt and that the accused is liable to be convicted. It has been proved that the accused A managed to escape during shootout and failed to appear before court despite announcement. Accordingly accused is held guilty” The Hon’ble Judge ordered while pronouncing the judgement.

At the outset, the Hon’ble Court vide a separate order and directed the Investigating Officer (hereinafter referred to as “IO”) to conduct an enquiry to determine financial condition of accused and his family to grant compensation to the victims. The Court also granted permission to the IO to include any other factor which can facilitate the aspect of compensation in the present case.
