“Clarify the procedure for repatriation, adopted in respect of such foreign nationals, who do not have any documents.”: Delhi High Court

The Hon’ble Delhi High Court on Wednesday (5th May 2021) sought a response from the Ministry of Home Affairs (hereinafter referred to as “MHA”) while hearing a plea filed by three Bangladeshi youths, who are stuck in Delhi and want to go home. Though they are unable to provide any documentary proof of their Bangladeshi citizenship.

The single-judge bench of Hon’ble Justice Prathiba M. Singh issued directions to MHA to place on record the procedure for repatriation, adopted in respect of such foreign nationals, who do not have any documents.

It was submitted before the Hon’ble Court that these people, who are claiming themself as citizens of Bangladesh, were found in a shelter home and also did not indulge in any criminal or other kinds of cases. Also, the Hon’ble Court was informed that a request letter of deportation had already sent to the Bangladesh High Commission on 24th March 2021. To this, Justice Singh said, “If any communication is received from the Bangladesh High Commission, it should be placed before the court within a period of two weeks.”

Lastly, the Hon’ble Court ordered the MHA to file the report with the answers to the following questions:

  1. What is the procedure to be adopted in such cases where no documentary evidence exists in respect of the nationality of a foreign national?
  2. What is the procedure for the deportation/repatriation of such foreign nationals?
  3. And if such a procedure exists, then what is the time period and formalities to be completed for the same?
