The Hon’ble Gujarat High Court has directed the parents in a Habeas Corpus petition not to harass their 18-year-old daughter who has decided to marry a 19-year-old boy after him attaining the age of marriage.
The Hon’ble Division Bench consisting of Hon’ble Justices RM Chhaya and Nirzar s Desai was hearing a Habeas Corpus plea by the father of the girl, who left her maternal home to live with a 19-year-old boy whom she wished to marry after him attaining majority.
The girl expressed before the Hon’ble Court her decision to marry the boy later and to maintain a personal relationship with him by talking to him over the phone. Stating the above-mentioned condition she agreed to return to her parental house for which the Counsel of the petitioner nodded to let her talk to the boy over the phone.
The Hon’ble Court taking note of the girl’s version, directed that a lady officer from the social welfare department shall ensure the well-being of the girl by making visits to her parental home from time to time for one year and submit a report on the same before the Hon’ble court.
