The Delhi Police had moved to the High Court of Delhi against the order that was passed by the trial court. The trial court’s order had imposed Rs. 25,000 cost on the same. the reason for this was the court called the investigation as farcical and most callous in context with a Riots case in Delhi.
The trial court was basically dealing with a revision petition that was filed by the SHO, PS Bhajanpura who was actually challenging the order that was directing them to register a separate FIR of one Mohd. Nasir had actually received injuries in the Riots of North East Delhi.
In the appeal against the order, the police had now stated that the session judge along with that the Metropolitan Magistrate had failed in taking into consideration sec. 210 of CrPC basically mandates the court below to proceed with the complaint cases that are in relation to the same offence once that had been brought to the knowledge of the court that such kind of an investigation is in process.
