Delhi HC denied bail to the riots accused who was involved in ‘Hashim Ali Murder Case’

The Hon’ble Delhi High Court on Friday (21st May 2021) dismissed the bail application of an accused who was involved in the murder case of Hashim Alidue to his role in the formation of the “Kattar Hindu Ekta” WhatsApp group is still under scrutiny. The accused, Pankaj Sharma, has been currently in judicial custody because his involvement in the aforementioned case that happened during the last year Delhi Riots.

The Hon’ble single judge bench comprising of Hon’ble Justice Suresh Kumar Kait observed: “In the case, that present before this Hon’ble court, the charges or allegations levelled against the accused are serious. In the alleged incident, a 19-years-old boy had been murdered. According to the post mortem report, around 42 serious injuries were found on the body of the deceased which could ordinally prove fatal for him. Besides this, the accused has been charged with another eight FIRs.” 

The accused had filed the petition to challenge the decree of the Hon’ble trial court refusing his bail application on the ground that the concerned Hon’ble court ignored the material facts available on record while dismissing his application.

To oppose the bail application, the SPP submitted before the Hon’ble  Court that role of the accused in the formation of the concerned WhatsApp group is still under scrutiny and also that the charges against him are serious and if the bail is granted, there is a high chance of threat by accused towards the witnesses.

 Thus, the bail application of the accused was dismissed on the ground of the material facts and the arguments presented before the Hon’ble Court.
