Complaint filed in Delhi HC for non-release of the certified copy of an order by family court

The Delhi High Court on Wednesday summoned the records of a matrimonial case from the Rohini Family Court after a petitioner filed a writ petition complaining of not releasing a certified copy of an order passed in July 2020. Describing the petitioner’s plea as “unusual”, a single bench of Justice Pratibha M Singh asked the High Court Registrar General to call the family court in physical or electronic form in a day to record the case.

Advocate Juhi Arora, legal counsel for the petitioner, stated that the petitioner had filed for divorce on the ground of mutual consent. On July 20, 2020, the Family Court passed an order allowing the first motion. However, despite repeated efforts, a certified copy of the order given by the Chief Justice has not been issued to the petitioner. Further, the counsel for the petitioner has been informed that the order passed on July 20, 2020 was not signed by the Presiding Office and hence is not being issued.

As the certified copy of the first motion has not been received, the petitioner stated that he is unable to move the second motion.
