In view of the Allahabad High Courts inquiry, in which it was concluded that although an order of the Supreme Court was obtained by the High Court, however, it was not referred to the concerned judge, the Supreme Court on Monday (March 22) gave administrative instructions. Directed the Chief Justice of the High Court to conduct a thorough investigation of the case. Justice D.Y. Chandrachud and Justice M.R. Shah’s bench considered the report filed by the senior registrar of the Allahabad High Court, which prima facie concluded that the 2 high court officials were responsible for tampering with the High Court records for not forwarding the order of the Supreme Court.
Further, it has been directed that all necessary steps should be taken expeditiously to comply with the directions of the Court within a period of four weeks, informing the Registrar (Judicial) of the Supreme Court. Also, the Registrar General of the High Court has been directed to submit his report to the Registrar (Judicial) of the Supreme Court within six weeks of the commencement of the proceedings. Further, to avoid such a situation in the future, the Registrar (Judicial) of the Supreme Court has been directed to apprise the court of the procedure under which the orders of the Supreme Court are not only communicated to the High Court by the Registry. It is also sent to the concerned judge, who has to take action in compliance with the court order. This report has been directed to be kept on record and will be taken along with the report of the Registrar General of the High Court.
