An appeal has been filed before the Bombay High Court, prayed for rescinding the differential costs for COVID vaccines declared by SII and Bharat Biotech, “with further direction to the Central government, State government to take all the steps ensuring the availability of the “COVID-19 vaccine” at uniform rate of Rs. 150/- per dose for the citizen by exercising powers under National Disaster Management Act, 2005, Essential Commodities Act and sovereign powers to achieve the goal of complete vaccination.”
The appeal was filed by a Mumbai based advocate Fayzan Khan and his three interns, who are law students, processed that the pharmaceutical companies are engrossed in organized loot and certainly the Honorable Court’s intervention is necessary to shield the national public health and to make sure the fundamental to equality and life are not left to the hands of the respondent, the pharmaceutical companies. The complainant’s soul disagreement was that since the powers laid under the National Disaster Management Act are entreated by the Central Government, it also has the authority to decide on fixing the costs of the vaccine rather than leaving that to a private entity. The petition further stated that the prejudice in cost would mean that BJP led state governments will be supplied by the Centre while the Non-BJP ruling states would be enforced to purchase the vaccines at a higher rate.
