The Delhi High Court restrained Anurag Srivastava from directing or indirectly publishing, re-publishing, sending or posting any tweet or information either in the electronic form or through internet, social media or email or any print or communication media, the statement is derogatory/defamatory in its content to TV Today Network Limited (India Today Group) or its top management or its anchors or its office bearers.
The Bench of Justice Mukta Gupta also directed to block/suspend the Twitter handle of Anurag Srivastava who is defendant no.1 in the case T.V. TODAY NETWORK LIMITED versus ANURAG SRIVASTAVA & ORS.
Considering the allegation in the plaint and also the documents filed herewith, the court found that plaint has found out its prima-facie case in its favour and if no ad-interim injunction is granted the plaintiff could suffer irreparable loss.
The Court directed, “Till the next date of hearing before this Court, defendant No. 1 (Anurag Srivastava) is restrained from directly or indirectly publishing, re-publishing, sending or posting any tweet or information either in the electronic form or through the internet, email of social media or any print or communication media whatsoever, the statement or post which is derogatory/defamatory in its contents to the plaintiff or its top management or its anchors or its other office bearers.
Court also directed, Twitter (defendant no.02) to block/suspend the Twitter handle of Anurag Srivastava (defendant no.01) and file basic subscription information of the account holder Anurag Srivastava of the Twitter accounts impugned i.e. @theanuragkts and @theanuragoffice in the Court and supply a copy thereof as a password-protected document to learned counsel for the plaintiff before the next hearing.
According to a report of web-portal ‘exchange4media’ last month, India today lodged a formal complaint with Twitter India and had decided to take legal action against Anurag Srivastava for his claiming that Rhea Chakraborty allegedly giving Rs.8crore to Rajeev Sardesai and India Today for her Interview.
Last month, Delhi High Court while directing Twitter to take down tweets against India Today group and Journalist Rajeev Sardesai, remarked that since social media is accessed by a large number of people of different age groups, it is expected of users to display sobriety and courtesy to those towards whom the comments are directed.
