Delhi High Court Expresses concern over rising COVID cases in capital, seeks ATR

The ICJ-International Council of Jurists moved to UNHRC-United Nations Human Rights Council seeking Trillions of Dollars as Reparations from China for having Caused “serious physical, psychological, economic and social harm” across World Nations by spreading Covid-19 Pandemic

The ICJ and AIBA-All India Bar Association has filed a Complaint in UNHCR against China, for Grave Offences committed against the Humanity in the form of Covid-19 Pandemic. ICJ accusations ranging from Inaction and Negligence to “Surreptitiously developing a Biological weapon capable of mass destruction of mankind throughout world”

The ICJ and AIBA wanted the UNHRC to Investigate and direct the government of the People’s Republic of China to “adequately compensate the international community and member-states for surreptitiously developing a biological weapon capable of mass destruction of mankind throughout world and negligence to respect the international obligations”. As the Corona virus Pandemic threatens a crisis for Human Rights

ICJ said China had violated provisions of IHR – International Health Regulations, International Human Rights and Serious Violations of International Humanitarian Laws and UDHR clauses. Pandemic started on 01st Dec, 2019, and how Chinese authorities were on denial mode till Jan, 2000,

The complaint lodged on 23rd Jan, 2020, two months after the first case of the virus was reported by Dr. Adish C Aggarwala, President of International Council of Jurists, and All India Bar Association Chairman, against People’s Republic of China, People’s Liberation Army and the Wuhan Institute of Virology for Biological Warfare against the world,  In Jan, 2020, China announced their first steps for a quarantine of Wuhan. By this time, “a significant number of Chinese citizens had travelled abroad as asymptomatic, oblivious carriers”.

The Complainant has alleged that the COVID-19 pandemic was a “conspiracy of Chinese government aimed at catapulting itself to the position of a superpower of the World and undermining other countries through Biological Warfare.” and also Violated Human Rights under UDHR – Universal Declaration of Human Rights

  • China has violated Article 25(1) of the UDHR, which highlights the Human Right to Health and well-being.

As per Article 25(1) of UDHR, China does not interfere directly or indirectly with the right to health of the citizens. However, China despite being aware of Covid-19 pandemic, knowingly withheld information

  • China has violated Article 12 of ICESR – International Covenant on Economic, Social and Cultural Rights which talks about right of everyone to the enjoyment of the highest attainable standard of physical and mental health.
  • China has violated Articles 6, 7, 9 of IHR – International Health Regulations about Information-sharing obligations during unexpected or unusual public health events.

WHO – World Health Organization calls Chinese Administration has consequently affected the right to physical and mental health of people across the globe. China’s legal liability under the Responsibility of States for Internationally Wrongful Acts, 2001.

Conclusion:

US President Donald Trump has insisted on a project of deliberate racial demonisation by calling Covid-19 the “Chinese virus” –harmful prejudice against East Asian Citizens, including those who have suffered shameful abuse in Britain. In one of the most surreal responses to the pandemic, commentators who are allergic to this form of social justice have discovered the concept of reparations – Not for the genocidal abuses committed by Europeans over the centuries, but for Europeans from the allegedly guilty Chinese.

China seeks India’s support to counter US Allegations

Beijing has sought New Delhi’s support to counter the attempt by the United States, not only to brand the Covid-19 as a “Chinese Virus”, but also to accuse China of failing to detect and stop the new coronavirus and to warn the world about it early enough

Chinese Foreign Minister Wang told Jaishankar that the US attempts to stigmatize China was “not acceptable and detrimental to international cooperation”. He expressed hope that India would oppose the comments made by the US President Donald Trump and other senior officials of his administration branding the Covid-19 as a “Chinese Virus”

“Chinese Ambassador to India Wang Yi said it is not acceptable and detrimental to international cooperation to label the virus and stigmatize China, hope India oppose such narrow mindset,”
