The petition herein is filed under section 482 Code of Criminal Procedure, 1973 (hereinafter referred to as “Cr. P.C, 1973”) read with Section 440 Cr. P.C, 1973 seeking modification of the condition imposed in trial order for grant of bail.

Further, Hon’ble Bench comprising Justice Manoj Kumar Ohri ordered that the trial court order be modified to the extent that the petitioner has released on bail on his furnishing only a personal bond in the sum of Rs.5,000/ to the satisfaction of the concerned Jail Superintendent/Duty M.M and without any surety.

Submissions of petitioner’s counsel are as follows:

Firstly, Petitioner herein has been granted bail in the other 2 FIRs because he managed surety bond(s) for the said two FIRs.

Moreover, the petitioner being a laborer and as he already managed surety in the above-mentioned cases the third surety for the requisite amount in the instant case could not be arranged and for which reason he continues to be in jail. 

It is further added that trial court too modified its order and the petitioner was directed to be released on bail on his furnishing bond in the sum of Rs.5,000/ with one surety valued at 5,000/.
