The Hon’ble Kerala High Court earlier this week on 07th July 2021, Wednesday dismissed a Habeas Corpus petition filed by a man who alleged that his wife and son were forcefully converted to Islam and were held illegally in the custody of an extremist body. The petitioner pleaded that his wife and son were illegally detained at the Therbiyathul Islam Sabha, a religious institution in Kozhikode and that their custody is granted to him.
It was informed to the Hon’ble Court by the Inspector of Police that the woman is the petitioner’s first wife’s sister and they were living together without being legally married. The woman moved out of the house of the Petitioner after differences arose between them. And the woman who started working in a bakery owned by a Muslim converted to Islam after being impressed with the religion.
The Hon’ble Division Bench of Hon’ble Justices K Vinod Chandran and Ziyad Rahman A. A after conversing with the woman remarked that she converted to Islam on her own will and there seems to be no coercion from anyone in her converting to Islam.
The Hon’ble Court further ordered that the police shall take immediate action to ensure that the Woman and her son live without any interruption and harassment after finding that they were being intervened by outsiders and the media.
