Nine Thailand Nationals granted bail by High Court of Allahabad

Life of Deceased Not Cheap Which Could Be Negotiated Between 2 Individuals

Allahabad Highcourt on 5th November, granted bail to nine Thailand nationals who had attended markaz at Nizamuddin, New Delhi in March 2020 this year. 

The said Thailand nationals were were alleged to have attended the Markaz at Nizmuddin, New Delhi and after that they went to Shahjahanpur and did not inform the DistrictMagistrate about their arrival.  The counsel for the applicants contended that the offence against the applicants were bailable except Section 14B of Foreigner Act, 1946.

Further, the counsel for the applicants submitted that they were implicated because of Masiullah; who being a resident of the country could not inform the District Magistrate and it was a fault on Masiullah’s part and others and not the applicants. 

The Allahabad High Court on 30th September directed that the cases pending in Kanpur, Varanasi, Prayagraj, Lucknow and Gorakhpur zones against the Tablighi Jamar members be transferred to Chief Judicial Magistrate, Lucknow.

The Court ordered that:  

“The applicants shall be enlarged on bail on execution of personal bond without sureties till normal functioning of the courts is restored. The accused will furnish sureties to the satisfaction of the court below within a month after normal functioning of the courts are restored. In case the court below is functioning normally, this condition will not apply and the applicant shall be enlarged on bail on execution of personal bond and two sureties to the satisfaction of the court below.”
