SC pulls up Petitioner for suppression of record

The Supreme Court bench of Justice DY Chandrachud, Justice Indu Malhotra and Justice Indira Banerjee while hearing a SLP against judgement of Delhi HC dtaes September 18th, where the petitioner who was candidate for recruitment as a Commissioned Officer in the 130th Technical Graduate Course of the Indian Army, impugned on cancellation of his candidature on January 21st which was rejected and even the review petition was dismissed in October.

Justice DY Chandrachud expressed his stern displeasure over failure of petitioner to submit the counter affidavit before SC which was submitted before the HC. He said that- “We will bend our backs to do justice, but we will also flex our jurisdiction if we are being taken for a ride. The practice before the Supreme Court of India has degenerated to this level! A material piece of record of the lower court is being suppressed from the Supreme Court? You think that this is a busy court and you will not file the counter before this court and be able to get an order?”

The court dismissed the SLP after hearing the counsel for the petitioner and asked why he didn’t submit the affidavit? A young man is trying to cut corners to go ahead and he wants to be in the army? The court reminded the counsel about taking serious note of this matter.
