UP Police Notice Under Section 41A Cr. P.C Without Sanction Of Law: Twitter India Chief To Karnataka HC

The council of Managing Director of Twitter Communications India Private Ltd., Mahesh Maheshwari, on earlier this week on 08th July 2021, Thursday made his submission to the Hon’ble Kerala High Court that he didn’t hamper between the investigation that was carried out by the Police of Uttar Pradesh. He just had informed his inability to personally visit the police station and record his statement when the notice was issued to him on 17th June 2021 under Section 160 of Code of Criminal Procedure, 1973 (hereinafter referred to as “Cr. P.C, 1973”).

Further, the Senior Advocate CV Nagesh who had appeared for Maheshwari made his submission before Hon’ble Justice G Narender.

The petitioner had challenged section 41A of Cr. P.C, 1973 notice issued to him by the police in an FIR related to Ghaziabad video.

The notice was issued to the witness under Section 160 Cr. P.C, 1973. Whereas the notice under Section 41A of Cr. P.C, 1973 was issued in place of arrest.

The hearing was to be continued on 9th July 2021, Friday. The Hon’ble High Court had earlier restrained the Uttar Pradesh Police from taking coercive action based on the notice.
