Centre said “putting names of COVID patients fine but not photos”

The Supreme Court bench of Justice Ashok Bhushan, Justice Shubhash Reddy and Justice MR Shah on Tuesday heard a plea filed by Advocate Kush Kalra who challenged the affixation of posters outside the home of COVID patients as identification mark and also sending names of such persons to Housing society Management and Residents Welfare Association. His plea challenged such affixation of posters and said that this is violation of Fundamental right to privacy.

The bench required the Centre to file its affidavit on the matter where Central Government filed its affidavit in the SC and said that posters and notices should not use photos of such patients.

The petitioner also states that such identification using photos and posters hamper the right to privacy and even our Constitution of India never does create a difference on the ground of Illness or any physical suffering. He also added that posting posters lead to widespread knowledge of their illness amongst the residents of the colony, complex, neighbours, household staffs, passers-by, etc.
