Delhi High Court closed the criminal defamation case against Kapil Mishra filed in 2017 by Delhi’s Health Minister Satyendra Jain for making defamatory statements against him & Delhi’s CM Arvind Kejriwal.
Case closed after Mr. Mishra agreed to provide an unconditional apology. Also Mr., Jain said that he is ready to take back his complaint if he agrees to give his statement before the court.
The incident occurred in 2017 when Mr. Mishra accused Satyendra Jain of giving bribe to CM Arvind Kejriwal of ₹2 crore. He also said that Mr. Jain settled a land deal of ₹50 crore of CM’s relative.
Mr. Jain challenged the authenticity of these statements and moved to file a complaint against Kapil Mishra under section 499 of the Indian Penal Code for criminal defamation.
Defamation (section 499 of IPC) – Whoever, by words either spoken or intended to be read, or by signs or by visible representations, makes or publishes any imputation concerning any person intending to harm, or knowing or having reason to believe that such imputation will harm, the reputation of such person, is said, except in the cases hereinafter expected, to defame that person.
