While in dismissal of an anticipatory bail application that was filed in a fake lawyer’s case, the Kerala High Court had remarked that any lawyer, once serving a client, owes paramount responsibility to his client first under any circumstances, and to the court only second.
Justice Shircy in the order issued by her stated that the profession of a lawyer’s is believed to be one of the noblest professions. Lawyers are the players of pivotal roles in the administration of justice to all, as it is only with their efforts and expertise that the Courts can administer justice properly in a fair manner.
The Bench has also accordingly put down a few duties that should be shouldered by the legal fraternity whenever it gives a judgment, especially towards the Courts. Their very first responsibility is that of the one towards their clients and then onto the courts. So, if one is misrepresenting or presenting themselves as a lawyer or an advocate before a client and is gaining access to their private information or is being briefed as an advocate, that would itself amount to cheating the public.
