Allahabad HC Orders To Stop Encroachments On Kabaristan By Ant-social Elements

The bench of Justice Dinesh Kumar Singh while rejecting the bail application against whom the FIR was registered under Sections 386 and 354A IPC and Section 66C of Information Technology Act, in Police Station Shahbad, District Hardoi, said that,

There is rise in crime of this nature in the society. The technology is being misused to commit the offence particularly against the women. The accused-applicant is accused of destroying and disrupting the young life. He has been threatening and blackmailing the prosecutrix.”

The FIR has filed against the accused-applicant as he has hacked the prosecutrix Instagram & SnapChat and sent obscene and objectionable messages from the Instagram & SnapChat of the prosecutrix to other students. Both the prosecutrix and accused were studying in Nalanda Sikshan Sansthan.

Further, he was pressurizing the prosecutrix to lodge the case against the family members by dialing 1090. When the prosecutrix refused to do so, he asked her to bring Rs.2 Lakhs, otherwise he would kill her younger brother in an accident. He also threatened her that he will viral the footage, audio and video of the prosecutrix and, if the information was given to the police against him, then entire family would be killed.

Therefore, the Court has rejected the bail application and stated that “Considering the heinousness of the offence and the involvement of the accused-applicant, I do not find any ground to release the accused-applicant on bail at this stage when the trial is yet to commence and the prosecutrix is yet to be examined in the case.”
