Justice Deepak Gupta said when asked by Chief Justice SA Bobde of a rape accused whether he would marry the victim. Justice Deepak Gupta said-
“Miserably it is a very patriarchal comments on the way things were viewed. Not only that, it is also lingering insensitivity.” Justice Deepak Gupta said this in the context of CJI SA Bobde’s remarks in which the 23-year-old man accused of raping a minor girl was asked by the CJI during the hearing of a case whether he would marry her. The girl is 16 years of age.
A bench headed by the Chief Justice was hearing a special leave petition filed by an accused of rape, who is a government employee in Maharashtra. He has filed this petition against the Bombay High Court order in which his anticipatory bail was canceled by the High Court. Retired Supreme Court Judge Deepak Gupta commented on the said case during an interview with senior journalist Barkha Dutt.
