The Hon’ble Tripura High Court stayed investigation into an FIR that was registered against the leader of CPI for his Facebook post calling locals to build resistance in case of any attack stating that if in case the police don’t take any action in the matter of attack at the house, then, in that case, the culprit must be taught a lesson.
The Hon’ble Bench of Hon’ble Chief Justice Akil Kureshi here observed that it was extremely doubtful that whether the post could be brought within the boundary of Section 153 A of the Indian Penal Code, 1860.
This provision provides the punishment for promoting enmity between different groups just on the grounds of religion, race, place of birth, residence, language, etc. And doing acts prejudicial to the maintenance of harmony.
