Explanation

Crescente malitia crescere debet et poena is a latin legal maxim which means that as the vice increases, the penalty or punishment must also increase. It calls for a tit for tat approach in criminal law. It accords penalty for an offence proportionate to the evil that is being committed by the accused. In other words, it states that punishment for a crime must increase as the malice behind the crime increases.
