SC rejects PIL seeking President’s rule in UP

The Supreme Court has recently rejected a PIL seeking to impose President’s rule in Uttar Pradesh. The petition was filed by CR Jaya Sukin, who is an advocate. The plea alleged that there was a breakdown of law and order, discrimination against minorities, and rising crimes against Dalits in UP.

 The petitioner also used various injustices that happened in Uttar Pradesh during the whole year like the illegal detention of Dr. Kafeel Khan, Hathras rape case, extrajudicial killings perpetrated by police, and so on. The petitioner also used reports from the National Crime Record Bureau’s “Crime in India” 2019 report, which said that Uttar Pradesh recorded the highest number of crimes against women. The petitioner then stated that the Uttar Pradesh Government has violated Article 14, 16, 21 of the Constitution of India and so Presidential rule should be imposed.

 In response to this, the CJI S A Bobde stated that the petitioner has done no research and also asked how it affected his fundamental rights. The Court then warned the petitioner of imposing heavy costs, if he proceeded to argue the plea any further and then dismissed the petition,
