The Hon’ble Division Bench of the Hon’ble High court of Kerala directed clearly to the appropriate government to inform or to give the reason or the justification to the Hon’ble court as to why the necessity to be funded were not provided to ensure free education of children of elementary schools.
Advocate Muhammed Shafi M and Anas Muhammed Shamnad, who was acting on behalf of the petitioner relied on the report Kerala Sasthra Sahitya Parishath regarding the availability of instruments and the books and all in the state. Further, he relied upon Section 8 of the Right of Children to Free and compulsory education act, 2009 to establish that it is the responsibility of the government to provide free and compulsory education to every child.
Advocate Surin George Ipe appeared on behalf of the respondent and had submitted that similar matters had already been raised against the Hon’ble division bench and the direction had already been issued. So no more direction in this context is required.
Advocate Jagadeesh Laxman who was representing the center had submitted that Kerala Sashtra Sahitya Parishath had already filed the report.
