The Hon’ble bench comprising Hon’ble Justice Tirthankar Ghosh while hearing a petition filed by the All India Trinamool Congress leader Sangram Kumar Dolai against BJP’s Ashoke Dinda who won the election against Dolai with 1260 votes majority in an election to Moyna constituency, ordered that as prima facie case been made out from the petition notice be issued to Dinda and accordingly, under Rule 24 of the Election Petition Rules, 1967, notice be also issued to the necessary parties.
Learned counsel for the petitioner mainly emphasized in the petition that there is suppression and misinformation furnished by the respondent while filing his nomination and the corrupt practices adopted by the returned candidate during the process of election.
Further, on Perusal of the report submitted by the Registrar, Original Side Hon’ble court observed that the petition preferred complies with the provisions of Section 83(1), 83(2), Section 84, and Section 117 of The Representation of the People Act.
Lastly, Petitioner is directed to file proper proof of service upon the necessary parties.
