The Rajasthan High Court had clearly stated that the right provided under Article 21 that is the Right to Life and Personal Liberty is to be protected irrespective of the fact that the relationship which is between the two major individuals may be termed as immoral and also considered unsocial.
Justice Satish Kumar Sharma observed that under Section 29 of the Rajasthan Police Act, 2007, every police officer in the State is duty-bound to protect the life and liberty of the citizens.
This observation was provided in a plea that was filed by a couple named Ajay Kumar Berwa and Samreen, who was living in a live-in relationship and was seeking police protection in view of the threats that was being faced by them.
The court relied upon the landmark judgement Lata Singh v. State of UP and S. Khushboo v. Kanniammal. The court relying upon this order that the petition is disposed of with the direction that the learned counsel for the petitioners will send the copy of the petition including the annexures to the Station House Officer.
The Officer shall consider and treat it as a complaint and after due enquiry, he shall take necessary preventive measures and other steps to ensure the safety and security of the petitioners.
