The Kerala High Court had recently fairly declared that an individual is entitled to the right to refuse any sort of medical treatment as per the Constitution, as such right does not affect the authorities of anyone to take measures that restore normalcy even amidst a worldwide pandemic.
The Collegiate Education’s Director issued a circular on 1st of October that directed students, teachers and other staff members who have taken both the doses of Covid-19 vaccine or one dose of the vaccine two weeks prior and those who have already previously recovered from Covid-19 within the last 1 and a half month only will be permitted to enter the educational institutions and their respective hostels.
The plaintiff’s case was also that the vaccine isn’t officially compulsory and the right to life that is guaranteed as per Article 21 of the Indian Constitution, especially the one that includes the right to privacy is something that is available to the petitioners for use and also gives them the freedom to avoid taking the vaccine if they wish to.
